Leo Stengel Bond, R.P.L.S. #5793 (Expired), Bastrop, TX; Case Numbers D–38482 and D-38494; SOAH Docket No. 460-22-0830
Violation:
For Case D-38482, Mr. Bond signed and sealed professional surveying work that was prepared by an unregistered individual where the work was not prepared under the direct supervision of Mr. Bond. Mr. Bond signed and sealed surveying work where Mr. Bond did not prepare the survey and Mr. Bond did not directly supervise its preparation. By signing and sealing a surveying document that was not prepared by Mr. Bond or under Mr. Bond’s supervision, Mr. Bond made representations that created a misleading impression that the surveying document was prepared by a registered professional land surveyor. By signing and sealing professional surveying work, Mr. Bond aided and abetted an unlicensed individual and an unregistered firm with the unauthorized practice of professional surveying.

For Case D-38494, Mr. Bond signed and sealed the second set of professional surveying work that was not prepared or directly supervised by Mr. Bond. Mr. Bond signed and sealed surveying work where Mr. Bond did not prepare the survey and Mr. Bond did not directly supervise its preparation. By signing and sealing the second set of professional surveying work that Mr. Bond knew he did not do himself, Mr. Bond made representations that created a misleading impression.
Act/Rule Violated: Two violations of Texas Occ. Code §1071.351(d), two violations of 22 Tex. Admin. Code §663.8(4), two violations of §663.10(7), and a violation of §663.10(8).
Resolution: Revocation of Registered Professional Land Surveyor Registration, $10,500 Administrative Penalty, and $200 in Costs of Administrative Hearing. 

David Aldana, San Antonio; TX; Case Number B-41115
Violation: Mr. Aldana performed engineering services without being licensed.  Also, Mr. Aldana used an engineering seal or a representation of an engineering seal without the express permission of the currently active licensee.
Act/Rule Violated: Tex. Occ. Code §§1001.004(c)(2)(A), 1001.301(a), (c), and (e), and 22 Tex. Admin. Code §137.37(b).
Resolution: Cease and Desist Order and Administrative Penalty of $3,000.00.

Jean Michael Bravo-Mejia, Individually, and doing business as Gibbons & Bravos Surveying, San Antonio, TX; Case Number B-40821
Violation: Mr. Bravo-Mejia, doing business as Gibbons & Bravos Surveying, offered professional surveying services without the entity being a registered surveying firm with the Board and without having a registered professional land surveyor employed full-time where the services are offered.
Act/Rule Violated: Tex. Occ. Code §1071.352(a).
Resolution: Cease and Desist Order.

John William Tobin, R.P.L.S. #4422 (Expired), Kyle, TX; Case Number D-40608
Violation: Mr. Tobin issued a misleading document by performing any acts which may be fraudulent, deceitful, or misleading, or which in any manner whatsoever, tend to create a misleading impression.
Act/Rule Violated: 22 Tex. Admin. Code §663.10(7).
Resolution: Reprimand.
