Violation: Ponce Engineering engaged in the practice of engineering while its firm registration was not current.
Act/Rule Violated: 22 Tex. Admin. Code §§137.77(d) and 137.77(e).
Resolution: Cease and Desist Order and Administrative Penalty of $750.00.

Ricardo Fierro-Stevens, P.E. #112842, El Paso, TX; Case Numbers D-37582 and D-38160
Violation: Mr. Fierro-Stevens neglected to practice engineering in a careful and diligent manner, which when measured by generally accepted engineering standards and/or procedures was reasonably likely to endanger the lives, health, safety, property, or welfare of the public and failed to properly supervise and control the use of his engineering seal.
Act/Rule Violated: 22 Tex. Admin. Code §§137.55(b) and 137.63(b)(6).
Resolution: Formal Reprimand, Administrative Penalty of $5,000, and successful completion of the TTU Engineering Ethics Intermediate Course.

Jorge Luis Trevino, P.E. #96485, Houston, TX; Case Number D-38128
Violation: Mr. Trevino aided and abetted a company in unlawfully representing it was a registered engineering firm and failed to practice engineering in a careful and diligent manner by failing to take steps necessary to safeguard his seal, continuing to assist a person who fraudulently used his seal, ad legitimately submitting at least three sets of plans to the Harris County Permits Office that contained multiple mistakes.
Act/Rule Violated: 22 Tex. Admin. Code §§137.63(b)(6) and 137.63(c)(1).
Resolution: One Year Probated Suspension contingent upon successful completion of the TTU Engineering Ethics Basic Course and remittance of an Administrative Penalty of $5,654.00.

Douglas Eugene Winters, Jr., P.E. #36558, Garland, TX; Case Number D-38398
Violation: Mr. Winters was disciplined by another jurisdiction after practicing engineering in that jurisdiction without holding a license.  If Mr. Winters conduct had occurred in Texas, it would have violated Tex. Occ. Code §1001.301(a).  Also, Mr. Winters did not properly and promptly notify the Board he had been disciplined by another jurisdiction's regulatory agency.
Act/Rule Violated: Tex. Occ. Code §1001.301(a) and 22 Tex. Admin. Code §137.5(c).
Resolution: Formal Reprimand.

Jordan Michael Rey, P.E. #117211, Dallas, TX; Case Number D-38530
Violation: Mr. Rey failed to notify the Complainant in writing of his intent to modify his signed and sealed engineering plans for a project.  Mr. Rey failed to practice engineering in a careful and diligent manner.
Act/Rule Violated: 22 Tex. Admin. Code §§137.33(i) and 137.63(b)(6).
Resolution: One Year Probated Suspension contingent upon successful completion of the TTU Engineering Ethics Basic Course and remittance of an Administrative Penalty of $4,462.00.

Craig Joseph Patterson, P.E. #71075, Boerne, TX; Case Number D-38602
Violation: Mr. Patterson misrepresented he completed 15 hours of continuing education for the 2020 renewal period.  By making such a misrepresentation, Mr. Patterson failed to engage in professional and business activities related to the practice of engineering in an honest and ethical manner.
Act/Rule Violated: 22 Tex. Admin. Code §§137.17(p)(3) and 137.63(a).
Resolution: One Year Probated Suspension and remittance of an Administrative Penalty of $1,500.00.

Neil B Hall & Associates LLC dba Groundtruth Forensics, #F-10716, Slidell, LA; Case Number D-40396
Violation: Neil B Hall & Associates LLC engaged in the practice of engineering while its firm registration was not current.
Act/Rule Violated: 22 Tex. Admin. Code §§137.77(d) and 137.77(e).
Resolution: An Administrative Penalty of $277.00.

Thomas Joseph Gaetano, P.E. #67711, Houston, TX; Case Number D-40487
Violation: Mr. Gaetano misrepresented he completed 15 hours of continuing education for the 2020 renewal period.  By making such a misrepresentation, Mr. Gaetano failed to engage in professional and business activities related to the practice of engineering in an honest and ethical manner.  Mr. Gaetano failed to respond to respond to multiple written requests for information by the date specified in the Board correspondence.
Act/Rule Violated: 22 Tex. Admin. Code §§137.17(p)(3), 137.51(c), and 137.63(a).
Resolution: One Year Probated Suspension and remittance of an Administrative Penalty of $1,500.00.

Daniel Ray Roseman, P.E. #126220, Blue Springs, MO; Case Number D-40561
Violation: Mr. Roseman was disciplined by two other jurisdictions after practicing engineering in those jurisdictions without holding a license.  If Mr. Roseman's conduct had occurred in Texas, it would have violated Tex. Occ. Code §§1001.004(c)(2)(A) and 1001.301(a).  Also, Mr. Roseman did not properly and promptly notify the Board he had been disciplined by another jurisdiction's regulatory agency.
Act/Rule Violated: Tex. Occ. Code §§1001.004(c)(2)(A) and 1001.301(a), and 22 Tex. Admin. Code §137.5(c).
Resolution: One Year Probated Suspension contingent upon successful completion of the TTU Engineering Ethics Basic Course.

Nathan Anton Seifert, P.E. #88640, Cedar Park, TX; Case Number D-40587
Violation: Mr. Seifert was disciplined by another jurisdiction after practicing engineering in that jurisdiction without holding a license.  If Mr. Seifert's conduct had occurred in Texas, it would have violated Tex. Occ. Code §§1001.004(c)(2)(A) and 1001.301(a).
Act/Rule Violated: Tex. Occ. Code §§1001.004(c)(2)(A) and 1001.301(a).
Resolution: Formal Reprimand.

Michael Harry Matustik, P.E. #75494, Austin, TX; Case Number D-40600
Violation: Mr. Matustik failed to practice engineering in a careful and diligent manner by failing to properly notate all information reviewed in forming his opinion and by failing to realize that pictures he reviewed were not taken by someone working under his direct supervision.
Act/Rule Violated: 22 Tex. Admin. Code §137.63(b)(6).
Resolution: One Year Probated Suspension contingent upon successful completion of the TTU Engineering Ethics Basic Course and remittance of an Administrative Penalty of $1,231.00.

Stewart Andre Aucoin, P.E. #74881, Eunice, LA; Case Number D-38250
Violation: Mr. Aucoin was disciplined by another jurisdiction after signing and sealing engineering plans that were not performed by him and not being competent in some of the engineering depicted on the plans he signed and sealed.  If Mr. Aucoin's conduct had occurred in Texas, it would have violated 22 Tex. Admin. Code §137.57(a), and §§137.59(a) and (b).  Mr. Aucoin did not properly and promptly notify the Board he had been disciplined by another jurisdiction's regulatory agency.  
Act/Rule Violated: 22 Tex. Admin. Code §§137.57(a), 137.59(a) and (b), and 137.5(c).
Resolution: The Respondent accepted an agreed revocation of his license as a professional engineer in Texas. 

Edward Christopher Rumsey, R.P.L.S. #5729, Austin, TX; Case Number D-38595
Violation: Mr. Rumsey issued a misleading document by failing to depict an easement on a survey, the lack of including the easement is misconduct in the practice of surveying.
Act/Rule Violated: Tex. Occ. Code §1071.401(a)(2) and 22 Tex. Admin. Code §663.10(7).
Resolution: Reprimand, Administrative Penalty of $4,500.00, and submittal of proof that a corrected survey has been filed within 30 days.

Bryan Douglas Connally, R.P.L.S. #5513, Rockwall, TX; Case Number D-40384
Violation: Mr. Connally issued a misleading document by issuing a signed and sealed surveying document that incorrectly identified the location of the west property line of the property.
Act/Rule Violated: 22 Tex. Admin. Code §663.10(7).
Resolution: Reprimand and Administrative Penalty of $1,500.00.
