Adam J. Huff, P.E. #132148, Heber City, UT; Case Number D-41262
Violation: Mr. Huff was disciplined by another jurisdiction after failing to apply the appropriate technical knowledge and skill in the practice of engineering.  The disciplinary action was on a matter that would constitute violations of the Texas Engineering Practice Act or board rules.  Mr. Huff performed an engineering function which, when measured by generally accepted engineering standard or procedures, was reasonably likely to result in the endangerment of lives, health, safety, property or welfare of the public and Mr. Huff failed to practice engineering in a careful and diligent manner.  Mr. Huff did not properly and promptly notify the Board he had been disciplined by another jurisdiction's regulatory agency.
Act/Rule Violated: 22 Tex. Admin Code §§137.5(c), 137.55(b), 137.63(b)(6), and 137.65(b).
Resolution: Formal Reprimand.

Dante Carlomagno, R.P.L.S. #1562, Bryan, TX; Case Number D-40796
Violation: Mr. Carlomagno evaded his statutory responsibility and/or his responsibility to a client, employer, and the public.  By issuing a signed and sealed surveying document that followed the fence line instead of the recorded deeds, Mr. Carlomagno issued a misleading surveying document.  Also, Mr. Carlomagno failed to follow the documented records of the land title affecting the boundaries being surveyed by not relying on the appropriate deeds and/or other documents including those for adjoining parcels for the location of the boundaries of the subject parcel(s).  Additionally, Mr. Carlomagno failed to set, or leave as found, an adequate quantity of monuments of a stable and reasonably permanent nature to represent or reference the property or boundary corners.
Act/Rule Violated: 22 Tex. Admin. Code §§663.3(3), 663.10(7), 663.16(3)(A), and 663.17(b).
Resolution: Reprimand, Administrative Penalty of $2,300.00, and Restitution of $2,300.00.

Jeffery Scott Cole, R.P.L.S. #5411, Highland Village, TX; Case Number D-40948
Violation: Mr. Cole performed any acts, allowed any omission, or made any assertions or representations which may have been fraudulent, deceitful, or misleading, or which in any manner whatsoever, tended to create a misleading impression by issuing an incorrect survey.  Also, by placing a property line incorrectly, Mr. Cole failed to follow the documented records of the land title affecting the boundaries being surveyed by failing to rely on the appropriate deeds and/or other documents including those for adjoining parcels for the location of the boundaries of the subject parcel(s).
Act/Rule Violated: 22 Tex. Admin. Code §§663.10(7) and 663.16(3)(A).
Resolution: Reprimand and Administrative Penalty of $2,800.00.
